簡(jiǎn)介:運(yùn)用文獻(xiàn)資料、調(diào)查訪談、個(gè)案研究、邏輯分析及比較等方法,并借鑒哲學(xué)、高等教育學(xué)、高等教育管理學(xué)、比較高等教育、歷史學(xué)、文化學(xué)、社會(huì)學(xué)、社會(huì)心理學(xué)、政治、經(jīng)濟(jì)學(xué)等多學(xué)科觀點(diǎn)和方法,對(duì)所獲得的資料和數(shù)據(jù)進(jìn)行分析研究,得出以下結(jié)論(1)閩臺(tái)兩地高等體育院校辦學(xué)模式,尤其是高校體育教育專業(yè)的辦學(xué)模式都有很大的相似之處;(2)閩臺(tái)雙方行政部門都已經(jīng)出臺(tái)相關(guān)政策來(lái)支持兩地高校包括體育教育專業(yè)在內(nèi)的多類專業(yè)合作辦學(xué),并且支持力度越來(lái)越大;(3)閩臺(tái)兩地高校體育教育專業(yè)合作辦學(xué)是閩臺(tái)體育事務(wù)交流與合作中重要的組成部分,將對(duì)閩臺(tái)各項(xiàng)事業(yè)的合作與交流起到推動(dòng)作用,故而顯的非常必要;(4)閩臺(tái)高校體育教育專業(yè)合作辦學(xué)有諸多的影響因素,其中有利因素大于障礙因素。在此基礎(chǔ)上,又對(duì)福建省部分已接收臺(tái)灣學(xué)生就讀的高校進(jìn)行實(shí)證考察,綜合分析之后,提出如下對(duì)策建議(1)閩臺(tái)高校體育教育專業(yè)合作辦學(xué)應(yīng)有體育行政機(jī)構(gòu)、教育主管機(jī)構(gòu)以及高?!皟傻亓健眳f(xié)調(diào)進(jìn)行;(2)閩臺(tái)雙方,尤其是臺(tái)方應(yīng)進(jìn)一步的拓寬兩地高校體育教育專業(yè)合作辦學(xué)的渠道;(3)閩臺(tái)高校體育教育專業(yè)合作辦學(xué)的實(shí)踐和理論研究應(yīng)同步進(jìn)行,且不能間斷。最后,在以培養(yǎng)人才為主的原則上,對(duì)閩臺(tái)兩地高校體育教育專業(yè)合作辦學(xué)的模式進(jìn)行探討,認(rèn)為(1)為使閩臺(tái)高校體育教育專業(yè)合作辦學(xué)順利進(jìn)行,須在政府主導(dǎo)下成立一個(gè)專門的、中介性質(zhì)的機(jī)構(gòu)來(lái)進(jìn)行具體的操作;(2)閩臺(tái)高校體育教育專業(yè)合作辦學(xué)的模式靈活多樣,但不管什么樣的模式,都應(yīng)以學(xué)分的相互認(rèn)可為前提,并力推學(xué)歷的互認(rèn)。

簡(jiǎn)介:為了實(shí)現(xiàn)高等教育治理體系與治理能力現(xiàn)代化,2014年,國(guó)家教育體制改革領(lǐng)導(dǎo)小組辦公室發(fā)布關(guān)于進(jìn)一步落實(shí)和擴(kuò)大高校辦學(xué)自主權(quán)完善高校內(nèi)部治理結(jié)構(gòu)的意見(jiàn),2015年教育部發(fā)布關(guān)于深入推進(jìn)教育管辦評(píng)分離,促進(jìn)政府職能轉(zhuǎn)變的若干意見(jiàn)。根據(jù)上述改革意見(jiàn),我國(guó)到2020年要基本形成政府宏觀管理、學(xué)校依法自主辦學(xué)、社會(huì)廣泛參與支持的格局。但30余年的改革證明政策路徑根本無(wú)法實(shí)現(xiàn)高等教育治理模式的構(gòu)建,要實(shí)現(xiàn)高等教育多元治理,就必須采取法治路徑,將高等教育治理納入法治化軌道。但高等教育治理模式并不是全部需要進(jìn)行法治化,而是應(yīng)當(dāng)對(duì)其重要的、穩(wěn)定的內(nèi)容進(jìn)行法治化。從系統(tǒng)論的角度講,高等教育治理系統(tǒng)重要的、穩(wěn)定要素就是高等教育治理主體(系統(tǒng)元素)和高等教育治理法律關(guān)系(系統(tǒng)結(jié)構(gòu))。而要建立高等教育治理法律關(guān)系模型,其核心就是對(duì)高等教育治理權(quán)責(zé)進(jìn)行法治化。當(dāng)然,在高等教育治理系統(tǒng)結(jié)構(gòu)建立后,難免也會(huì)出現(xiàn)高等教育治理失序的現(xiàn)象。因此,為了避免高等教育治理失序,就應(yīng)當(dāng)對(duì)高等教育治理的運(yùn)行從法律程序上進(jìn)行過(guò)程控制,從法律責(zé)任上進(jìn)行結(jié)果控制。全文結(jié)構(gòu)安排如下第一章緒論部分從選題背景出發(fā),介紹研究意義,對(duì)國(guó)內(nèi)外研究進(jìn)行綜述,并對(duì)本文研究思路與主要內(nèi)容、研究方法與主要?jiǎng)?chuàng)新點(diǎn)進(jìn)行介紹。第二章對(duì)高等教育治理法治化的基本概念進(jìn)行界定;闡述高等教育治理法治化的理論基礎(chǔ);闡述高等教育治理法治化的必要性;通過(guò)對(duì)我國(guó)高等教育治理模式的分析,明確我國(guó)高等教育治理法治化的基本內(nèi)容,包括高等教育治理主體法治化、高等教育治理關(guān)系法治化、高等教育治理權(quán)責(zé)法治化、高等教育治理法律程序與法律責(zé)任。第三章對(duì)我國(guó)高等教育治理法治化的現(xiàn)狀進(jìn)行分析,當(dāng)前我國(guó)高等教育治理法治化過(guò)程中存在高等教育治理主要停留在政策層面,立法欠缺;高等教育治理存在有法不依現(xiàn)象;政府高等教育改革隨意性太強(qiáng);高校辦學(xué)偏重政府,難以實(shí)現(xiàn)面向社會(huì)辦學(xué)等問(wèn)題。我國(guó)高等教育治理法治化還存在政府方、高校方、社會(huì)方障礙,阻礙高等教育治理法治化的進(jìn)程。另外,由于我國(guó)行政權(quán)力過(guò)于強(qiáng)大、存在權(quán)力腐敗、非營(yíng)利組織異化與法治政府和法治理念欠缺,我國(guó)高等教育治理存在失序可能。第四章對(duì)我國(guó)高等教育治理主體法治化進(jìn)行理論分析。首先,界定了高等教育治理主體的概念與范圍;其次提出了高等教育治理主體法治化的概念,其核心就是要通過(guò)法律賦予高等教育治理主體資格(權(quán)利能力),以保障高等教育治理主體的廣泛性、獨(dú)立性、組織性、專業(yè)性;第三,對(duì)高等教育治理主體中的政府主體、高校主體、社會(huì)主體的資格進(jìn)行了探討,主要論述了高校主體的獨(dú)立行政法人資格的應(yīng)然設(shè)計(jì)、社會(huì)主體資格確認(rèn)的必要性與“法律松綁”。第五章對(duì)高等教育治理關(guān)系法治化進(jìn)行論述。在界定高等教育治理關(guān)系法治化的基礎(chǔ)上,提出高等教育治理關(guān)系法治化不是對(duì)高等教育治理關(guān)系全盤(pán)法治化,而是對(duì)高等教育行政管理關(guān)系,重要的、穩(wěn)定的高等教育平權(quán)治理關(guān)系進(jìn)行法治化,并對(duì)高等教育治理法律關(guān)系模型、高等教育治理法律關(guān)系的種類等內(nèi)容進(jìn)行探討。在高等教育治理法律關(guān)系種類上,重點(diǎn)介紹了高等教育行政管理法律關(guān)系、高等教育重大行政決策法律關(guān)系、理事會(huì)決策法律關(guān)系、契約法律關(guān)系、投資撥款法律關(guān)系、政務(wù)服務(wù)法律關(guān)系。第六章對(duì)高等教育治理權(quán)責(zé)法治化進(jìn)行分析。在界定高等教育治理權(quán)責(zé)法治化的概念基礎(chǔ)上,提出了高等教育治理權(quán)責(zé)分配的基本原則,包括均衡分配原則、分權(quán)治理原則、清單管理原則(正面清單與負(fù)面清單);并在此基礎(chǔ)上對(duì)政府權(quán)責(zé)、高校權(quán)責(zé)、社會(huì)權(quán)責(zé)進(jìn)行了分配。第七章對(duì)高等教育治理過(guò)程序與結(jié)果的法律規(guī)制進(jìn)行分析,提出在過(guò)程控制方面,主要要建立健全行政管理法律程序、高等教育重大行政決策參與法律程序、理事會(huì)決策法律程序、招投標(biāo)程序、治理糾紛解決程序;在結(jié)果控制方面,重點(diǎn)要完善政府越權(quán)行為的法律責(zé)任追究、高等教育質(zhì)量保障責(zé)任的法律責(zé)任追究、違反高等教育公平責(zé)任的法律責(zé)任追究。第八章對(duì)我國(guó)高等教育治理法治化的對(duì)策進(jìn)行分析,提出通過(guò)將高等教育治理法治實(shí)施體系、監(jiān)督體系、保障體系內(nèi)嵌于高等教育治理法律規(guī)范體系當(dāng)中,通過(guò)修訂與制訂高等教育法高等學(xué)校法高等教育中介組織法高等教育社會(huì)團(tuán)體管理辦法高等教育重大行政決策程序規(guī)定形成高等教育治理法治體系,以確保高等教育治理法治化的順利開(kāi)展。

簡(jiǎn)介:高等教育評(píng)估不僅僅是一個(gè)教育問(wèn)題,也是一個(gè)法律問(wèn)題。政府高等教育評(píng)估行為主要是指由教育行政部門按照一定的價(jià)值標(biāo)準(zhǔn),對(duì)高等學(xué)校及其他教育機(jī)構(gòu)的辦學(xué)水平、辦學(xué)條件、教育質(zhì)量等進(jìn)行考核、評(píng)價(jià)等,從而作出相應(yīng)評(píng)估結(jié)論的行為。實(shí)踐中,政府高等教育評(píng)估行為與教育行政指導(dǎo)、教育行政監(jiān)督、教育行政獎(jiǎng)勵(lì)、教育行政許可、教育行政確認(rèn)等既有聯(lián)系,亦有區(qū)別。政府高等教育評(píng)估行為應(yīng)當(dāng)是一種獨(dú)立的具體行政行為。政府高等教育評(píng)估行為所凸顯出來(lái)的特殊性使現(xiàn)有的行政法學(xué)理論對(duì)這個(gè)問(wèn)題的關(guān)照逐漸顯得力不從心。事實(shí)上,也已經(jīng)對(duì)傳統(tǒng)的行政行為理論架構(gòu)造成了沖擊。目前,我國(guó)政府高等教育評(píng)估行為的運(yùn)行有評(píng)估實(shí)施的強(qiáng)制性、評(píng)估內(nèi)容繁多、評(píng)估效力多元、評(píng)估標(biāo)準(zhǔn)統(tǒng)一、評(píng)估法律程序不完備、相對(duì)人救濟(jì)權(quán)利依據(jù)不足、評(píng)估責(zé)任缺失等問(wèn)題。本文運(yùn)用比較的研究方法,在對(duì)我國(guó)政府參與高等教育評(píng)估行為的政策發(fā)展脈絡(luò)進(jìn)行梳理和對(duì)國(guó)外政府參與高等教育評(píng)估的行為模式進(jìn)行分析的基礎(chǔ)之上,認(rèn)真總結(jié)了國(guó)外高等教育評(píng)估的經(jīng)驗(yàn)和我國(guó)政府在高等教育評(píng)估中的教訓(xùn)。提出了對(duì)我國(guó)政府高等教育評(píng)估行為法律規(guī)制的基本思路原則指引、程序構(gòu)建、裁量治理和司法審查。有限原則的確立指引了政府高等教育評(píng)估的運(yùn)行過(guò)程。我國(guó)政府高等教育評(píng)估過(guò)程缺乏正當(dāng)程序的觀念,而公開(kāi)機(jī)制、參與機(jī)制、協(xié)商機(jī)制和責(zé)任機(jī)制的構(gòu)建則能夠有效保證評(píng)估程序的正當(dāng)性。自由裁量是政府高等教育評(píng)估中的核心問(wèn)題,正當(dāng)?shù)牟昧炕鶞?zhǔn)的應(yīng)用減少了政府高等教育評(píng)估中的非正義因素。司法審查是對(duì)作為一種具體行政行為的政府高等教育評(píng)估行為的一種有力的監(jiān)督、控制機(jī)制,同時(shí)也是一種對(duì)政府高等教育評(píng)估中行政相對(duì)人權(quán)益的有效保障機(jī)制。評(píng)估啟動(dòng)的法定化、評(píng)估內(nèi)容的確定性和效力的法定化、注重評(píng)估程序設(shè)計(jì)、完善評(píng)估救濟(jì)機(jī)制、追究評(píng)估行為瑕疵的法律責(zé)任則是我國(guó)政府高等教育評(píng)估行為的具體規(guī)制路徑。本文對(duì)政府高等教育評(píng)估行為的研究只是對(duì)行政評(píng)估行為研究的一種序言。行政評(píng)估行為本身具有更為深刻的含義、內(nèi)容和規(guī)則。這種序說(shuō)式的開(kāi)發(fā)性研究,能夠?qū)π姓u(píng)估行為的研究起到拋磚引玉的作用。
